General Rules and Fines (word doc)

Assessments:
1. A charge of $50 will be made to any 30 day late Assessment and an additional charge of $50 for every 30 days late thereafter.

2. Additional charges for late Assessment will the prime rate, + 1% on any unpaid balance. Homeowner is responsible for any fees associated with collection.

Structures:
1. No structure shall be erected inside the building lines of your lot. There is a 10 foot easement surrounding each lot, therefore no structure shall be placed on this easement.

2. Sheds that are next to rear of house (within 1 foot) and are not visible from plain street view that are no more than 4 feet in height. These structures are Rubbermaid®/Suncast® type and will need the approval of the Architectural Control Committee. There will not be a fee for these requests. 3. Other types of sheds that are of similar style of the house, siding, shingles and roof line will be considered for approval. Plans (including placement on the lot) need to be submitted to the Architectural Control Committee.

Animals:
1. Animals need to be limited to a maximum of two.

2. Please make sure you pick up your animals' waste whether it is an open lot, common ground or another resident's lawn.

3. Please do not allow your pets to urinate on other resident's property.

Commercial Vehicles:
1. Commercial vehicles not exceeding a maximum of ¾ ton will be allowed to park at resident's home (Driveway only).

2. Vehicle shall be properly licensed, good condition (no major body damage and matching paint). Vehicle should not block sidewalk.

Boats, Campers, Trailers, etc.:
1. No boats, trailers, campers, jet skis or any other item shall be parked in driveway except for loading, unloading or general maintenance not to exceed 48 hours.

2. While loading and unloading, no boat, camper or trailer shall block the sidewalk.

Vehicles:
No vehicle shall block the sidewalk.

Maintenance:
1. Lawn must be mowed and maintained on a regular basis and mostly weed free. Lawn maintenance includes cutting, fertilizing and watering (unless we are under a water conservation order).

2. Vinyl siding should be cleaned and free from dirt and mold. Shutters should be cleaned and in good condition.

3. Bushes should be trimmed on a regular basis.

4. Sidewalk in front of home should be clear. (Please do not park cars across sidewalk).

Fence:
1. All fences must be approved prior to being put up. Approval is for fence appearance only, homeowner responsible for boundary line locations.

2. In general no privacy or chain link fences will be allowed. Fence should be 48" tall, vinyl, wood, aluminum or wrought iron.

3. Please submit for approval to Smith Management and allow 30 days for approval. Most approvals should be sooner, but we would like some additional time in case questions arise.

Trash Containers:
1. Trash containers need to be stored away from any view.

2. Containers may be stored outside behind building line and out of plain view. You may erect a structure shielding the view, this structure needs to be approved by the Architecture Control Committee. You may place plants in an area and store container as long as this blocks view year round.

Fines and Notices:
1. A letter will be sent to inform the resident of an outstanding rule issue with a stated time to correct. The Trustees will reserve the right to send this warning letter prior to any fines charged.

2. If no reasonable attempt to correct and no communication a $25 fine will be imposed.

3. Any fine outstanding for 30 days will incur an additional charge of $10 and for every 30 days thereafter an additional $10 charge.

The enforcement of the Restrictions of the Indentures is the responsibility of the Trustees and any communication will be sent from Smith Management. You can contact any one of the Trustees or a member of the Rules and Regulation Committee for clarification.
